1. Purpose and seller
These terms govern the creation of websites sold on this platform by WebPro, Eliezer Elgrabli, entrepreneur individuel (EI), nom commercial WebPro, registered office 4 rue du Maréchal Foch, 67000 Strasbourg, registration number RCS Strasbourg 825 117 971 — SIRET 825 117 971 00028, contact contact@webpro200.com.
2. Price and payment
A website costs €500 including VAT, paid in two instalments: a €250 deposit when ordering, then a €250 balance when the client approves the site. Payments are processed by Stripe. An invoice is issued for each payment and remains available in the client area.
3. Hosting after delivery
On delivery, the client subscribes to hosting at €5 including VAT per month for a showcase site, or €15 per month for a site with a database. The first month is free. The subscription is billed monthly by card, with no minimum term, and can be cancelled at any time from the client area, effective at the end of the current month. If cancelled or left unpaid, the site is taken offline; the client keeps the source code and may host it elsewhere.
4. Deposit refund
For 30 days from payment of the deposit, and until the balance is paid, the client may request a full refund of the deposit without giving a reason. The refund is issued immediately to the original payment method. The project is then archived and the preview disabled. After this period, the deposit is no longer refundable at the client's request, subject to section 9. A project whose balance is unpaid 120 days after the deposit is archived, without refund of the deposit, and its preview disabled; the client is notified.
5. Right of withdrawal
A consumer client has 14 days from the order to withdraw, without giving a reason, by writing to contact@webpro200.com or from the client area. By ordering, the client asks for work to begin as soon as the deposit is paid. The more favourable full deposit refund described in section 4 applies in any case for 30 days from payment of the deposit, until the balance is paid. The right of withdrawal no longer applies once the site has been delivered at the client's request and the service fully performed.
6. Scope
The service covers a website matching the specification approved by the client. Changes are included at no extra cost until approval, with at most three updates a day and within the project's lifetime (120 days after the deposit), within the scope of a website. Mobile apps and business software are excluded. The client warrants that it holds the rights to the texts, images and trademarks it provides.
7. Delivery and ownership
When the balance is paid, the site goes live and the client receives the complete source code and becomes its owner. Until then, the site and its code remain the seller's property. The domain name is at the client's expense.
8. Personal data
How personal data is processed is described in the privacy policy, linked from every page of the platform.
9. Inability to build the site
If the seller is unable to build or deliver the site for any reason (technical difficulty, malfunction, request that cannot be met or any other cause), it refunds the deposit in full. This refund settles the project for good: no further sum, compensation or service is owed to the client, and the client owes nothing more. This clause does not limit the mandatory rights the law grants consumers, in particular in case of gross negligence or wilful misconduct.
10. Liability
Before delivery, the seller's liability for a project is limited to the amount actually paid by the client for that project, subject to mandatory consumer law, in particular the legal guarantee of conformity for digital content and services.
11. Complaints and mediation
Any complaint should first be sent to contact@webpro200.com. If no solution is found, a consumer client may refer the matter free of charge to the consumer mediator: a, https://www.cm2c.net. The European online dispute resolution platform is also available.
12. Governing law
These terms are governed by French law. Consumers keep the protection of the mandatory rules of their country of residence. Failing an amicable settlement, the courts designated by law have jurisdiction.
